Kazemi rethink must cover other gay Iranians too

Liberal Democrat European justice spokeswoman Baroness Sarah Ludford MEP has welcomed the change of heart by Home Secretary Jacqui Smith who has said new circumstances may cause her to reconsider the case of Mehdi Kazemi, the gay Iranian teenager threatened with deportation to Iran after refusal of his asylum claim.
This development came shortly after the European Parliament voted to demand that his strong claim to protection, and that of any Iranian homosexual in a context of state repression, torture and execution of gay people, be recognised.
Sarah Ludford said:
"This is a welcome move, even if it should have come voluntarily and without the need for so much pressure."
"But we must not forget other gay Iranians fearing for not only their liberty but their lives, such as Pegah Emambakhsh. They deserve justice too."

Dreiging voor homo’s: Iran en Moskou
Vanmorgen hebben we met vertegenwoordigers van alle fracties overlegd over een resolutie van het Europees Parlement over de zaak van de 19 jarige homoseksuele Mehdi Kazemi die in zijn vaderland Iran de doodsstraf boven het hoofd hangt wegens zijn homoseksualiteit. Zijn vriend is al geëxecuteerd. Mehdi had eerst in Groot Brittannië asiel aangevraagd, en kwam toen naar Nederland. Maar Nederland stuurt hem nu terug naar Groot Brittannië, waar hem uitzetting naar Iran boven het hoofd hangt. Volgens Europese afspraken (de Dublin conventie) moet een asielaanvraag worden afgehandeld in het eerste land waar hij is ingediend, om "asielshoppen" tegen te gaan. In de Tweede Kamer heeft Boris van der Ham er bij Staatssecretaris Albayrak op aan gedrongen Mehdi niet uit te zetten, met beroep op een uitzonderingsclausule op die regel. Maar tevergeefs: Mehdi wordt toch uitgezet.
Mijn Liberale ALDE fractie heeft een resolutie opgesteld waarin we vooral een beroep doen op de Britse regering om het asielrecht fatsoenlijk toe te passen, en seksuele oriëntatie te erkennen als grond voor asiel. In een eerder geval van een Iraanse lesbienne hebben de Britten De Socialisten en de Groenen hebben mede-ondertekend. De Conservatieven/Christen-Democraten hebben nog geen formeel standpunt ingenomen, maar ik hoop van ganser harte dat ze zich aansluiten bij onze oproep. Intussen zijn er diverse petities gestart aan de Britse regering om Mehdi asiel te verlenen.
Ik ga ervan uit dat de Britten “the right thing” zullen doen, maar het kan niet langer dat er steeds opnieuw voor elk individueel geval een last minute reddingsactie op touw moet komen. Er moet nu in Europees verband worden afgesproken dat homoseksuelen niet worden uitgezet naar Iran. Binnenkort komt er een herziening van de Dublin regeling. Daar zullen we dit beslist inbrengen.

Steun voor Kazemi
Tot mijn vreugde heeft het Europees Parlement de oproep gesteund om Mehdi Kazemi niet uit te leveren aan Iran. De woordvoerder van de Christen Democraten kwam met een formalistische smoes waarom ze tegen zouden stemmen. Maar na een emotioneel betoog van de Britse Conservatief John Bowis (drie hoeraatjes voor die man!), krachtig bijgevallen door Eurocommissaris Louis Michel, krabbelden ze terug en onthielden zich van stemming.

Christen Democraten in EP geven geen steun aan Iraanse homo 13.03.2008
Bij aankomst in het parlement vanmorgen hoor ik dat de fractie van Christen Democraten gisteravond heeft besloten om de resolutie over Mehdi Kazemi, de 19 jarige Iraanse homoseksuele asielzoeker, niet te steunen in de stemming vanmiddag. Ze dragen allerlei formele juridische argumenten aan. Maar ik ben boos en geschokt. Kennelijk zit de weerzin tegen homoseksualiteit zo diep dat ze liever iemand de doodstraf zien krijgen dan dat ze voor een resolutie stemmen. De resolutie is slechts een politiek standpunt van het Parlement, maar het helpt wel enorm om de druk op de Britse regering op te voeren.
Vanmorgen op het Duitse TV journaal alweer het zoveelste geval van seksueel misbruik van kinderen door priesters, dat jarenlang stelselmatig is toegedekt door de kerkelijke instanties. Laten de Christen Democraten zich dáár nou eens over opwinden!
Ik probeer zoveel mogelijk voorstanders te mobiliseren om vanmiddag bij de stemming aanwezig te zijn (niet eenvoudig, want veel mensen vertrekken in de loop van de middag en kunnen moeilijk hun vlucht afzeggen).

European Parliament votes to save Mehdi Kazemi from deportation to Iran

I hope that Jackie Smith will intervene immediately in the case of Mehdi Kazemi to prevent him from being deported to Iran
Jean Lambert MEP today appealed to the European Parliament to support Mehdi Kazemi, a gay, 19 year old faced with deportation to Iran where he could face the death penalty. Ms Lambert called for him to be granted asylum in the EU and tabled a joint motion on behalf of the Greens to this effect, which was subsequently adopted by the Parliament.
In Iran homosexuality is punishable by death and the young man's former partner was hanged after being arrested for engaging in homosexual acts. Mr Kazemi's asylum application in the UK was turned down in 2005 and on Tuesday this week the Netherlands refused his request to apply for protection. He is now awaiting deportation from the UK.
Speaking in the debate in the European Parliament, this afternoon, Jean Lambert MEP said:
"I hope that Jackie Smith will intervene immediately in the case of Mehdi Kazemi to prevent him from being deported to Iran. We know that Iran is very dangerous for homosexuals. The UK Government has said that it will be safe for him to return if he is discreet in his behaviour, but it would be impossible for him to live freely in Iran.
"It appears that the UK Government is more interested in increasing the numbers of people being deported than it is in protecting human life."
The debate was followed by a vote on the joint motion to protect Mr Kazemi from deportation. The motion was carried with an overwhelming majority and adopted as a position of the European Parliament. Speaking after the debate, Jean Lambert MEP continued:
"The deportation of anyone to a country where they risk persecution, torture and death amounts to a violation of European and international human rights obligations.
"There is no doubt that Mehdi Kazemi will be in danger if returned, his former partner has been executed and his own father has threatened to kill him. Obviously this is an extremely distressing situation for him and the Member States involved should resolve his status as quickly as possible."
In Europe, the Dublin 2 Regulation advises Member States to send asylum-seekers back to the first country in which they claimed asylum, unless there was an error in the original decision-making process. Jean Lambert MEP is currently leading the European Parliament's evaluation of this legislation.

Straatsburg, 12 maart. Het Europees Parlement eist van de EU-landen dat een homoseksuele Iraanse asielzoeker bescherming wordt verleend. De 19-jarige Mehdi Kazemi dreigt te worden teruggestuurd naar Iran, waar hij vanwege zijn homoseksualiteit vrijwel zeker de doodstraf krijgt.

Kazemi vroeg eerst asiel aan in Groot-Brittannië maar dat werd daar geweigerd. Vervolgens deed hij hetzelfde in Nederland, maar dat weigerde zijn verzoek te behandelen omdat hij al in Groot-Brittannië een asielverzoek had ingediend.
Europarlementariërs vrezen dat Kazemi nu de dupe wordt van Europese bureaucratie. ,,Het gaat hier om een mensenleven. Deze jongen gaat een zekere dood tegemoet als je ,,Europese regels zijn leuk, maar willen politici de dood van deze jongen op hun geweten hebben'', vraagt In 't Veld zich af.
VVD-europarlementariër Jeanine Hennis noemt het een ,,grof schandaal'' als de EU zou laten gebeuren dat Kazemi wordt teruggestuurd naar Iran.
In Nederland trok vooral D66-Kamerlid Boris van der Ham aan de bel over het lot van Kazemi. Maar de Raad van State wees het hoger beroep van Kazemi tegen de afwijzing van zijn asielaanvraag af.
Staatssecretaris Nebahat Albayrak van Justitie meldde de Kamer eerder dat zij ervan uitgaat dat Groot-Brittannië de jongen niet terugstuurt naar Iran als zijn leven daar in gevaar is.

De uitspraak in het Nederlands 
1. spreekt zijn ernstige bezorgdheid uit over het lot van Mehdi Kazemi;
2. dringt aan op de correcte en volledige implementatie van de "minimumnormenrichtlijn", waarin vervolging op grond van seksuele geaardheid wordt erkend als reden voor het toekennen van asiel en waarin bepaald dat de lidstaten rekening moeten houden met individuele gevallen en met de situatie in het land van herkomst, met inbegrip van de wetten en voorschriften, en de manier waarop zij worden toegepast;
3. is van mening dat de EU en haar lidstaten de Europese en nationale wetten en procedures niet op die manier mogen toepassen dat burgers worden uitgezet naar een derde land waar zij dreigen te worden vervolgd, gefolterd of ter dood gebracht, aangezien dit een schending zou inhouden van de Europese en de internationale mensenrechtenverbintenissen;
4. roept de betrokken lidstaten ertoe op gezamenlijk een oplossing uit te werken die Mehdi Kazemi asielrecht of bescherming op Europees grondgebied waarborgt en verhindert dat hij wordt teruggestuurd naar Iran, waar hij zou worden terechtgesteld, zodat kan worden gegarandeerd dat artikel 3 van het Europees Verdrag tot bescherming van de rechten van de mens volstrekt wordt nageleefd door alle Europese autoriteiten en met name in dit geval het Verenigd Koninkrijk; verzoekt de Commissie en de Raad in deze zaak volledig samen te werken met de lidstaten;
5. verzoekt de Europese instellingen en de lidstaten maatregelen te nemen om soortgelijke situaties in de toekomst te voorkomen door middel van onderlinge samenwerking en Europese richtsnoeren om in soortgelijke gevallen oplossingen uit te werken; verzoekt de Commissie de toepassing van de Europese asielwetgeving in de lidstaten te controleren en te evalueren, in het bijzonder met betrekking tot de seksuele geaardheid, en hierover aan het Parlement verslag uit te brengen; onderstreept dat de Commissie voor 2008 wijzigingen op de Dublin-verordening en de Kwalificatierichtlijn heeft aangekondigd die specifiek op de vraagstukken van deze resolutie zullen inspelen;
6. verzoekt zijn Voorzitter deze resolutie te doen toekomen aan de Commissie, de Raad, de lidstaten, de Hoge Commissaris van de VN voor de Vluchtelingen, en Mehdi Kazemi.

The European Parliament,
– having regard to the European Convention on Human Rights (ECHR), and in particular to Article 3 thereof, which prohibits the removal, expulsion or extradition of persons to countries where there is a serious risk that they would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment,
– having regard to the Charter of Fundamental Rights, and in particular to Articles 18 and 19 thereof on the right to asylum and on protection in the event of removal, expulsion or extradition respectively,
– having regard to the Geneva Convention of 28 July 1951 and the Protocol of 31 January 1967 relating to the Status of Refugees,
– having regard to Council Directive 2004/83/EC on minimum standards for the qualification and status of third country nationals or stateless persons as refugees or as persons who otherwise need international protection and the content of the protection granted (Qualifications Directive) and to Council Regulation (EC) No 343/2003 on the criteria and mechanisms to determine the Member State responsible for assessing asylum applications (Dublin Regulation), as well as to other EU asylum instruments,
– having regard to the letter of 10 September 2007 from its President to the UK Prime Minister on the case of Pegah Emambakhsh, an Iranian lesbian who risked being sent back to Iran after her request for asylum was turned down,
– having regard to Rule 115(5) of its Rules of Procedure,
A. whereas Mehdi Kazemi, a 19-year-old gay Iranian citizen, requested asylum in the United Kingdom and had his application turned down; whereas, fearing deportation, he fled to the Netherlands, where he applied for asylum; whereas Dutch authorities, after examining his request, have decided to send him back to the UK,
B. whereas UK authorities are now left with the final decision on his asylum application and possible deportation to Iran,
C. whereas Iranian authorities routinely detain, torture and execute persons, notably homosexuals; whereas Mehdi's partner has already been executed, while his father has threatened him with death,
D. whereas in the similar case of Pegah Emambakhsh the UK authorities decided, after international pressure, not to deport her back to Iran, but whereas it is still not clear what her fate will be,
E. whereas the UK Prime Minister’s spokesperson, while not commenting on the case of Mehdi Kazemi, gave general assurances as to the conformity of UK asylum procedures with international commitments and to the possibility of appealing against asylum decisions to an independent judge, as well as to the fact that the authorities would not remove anyone who would be at risk on his or her return,
F. whereas more attention should be devoted to the proper application of EU asylum law in Member States as regards sexual orientation,
1. Expresses its serious concern regarding the fate of Mehdi Kazemi;
2. Asks for the proper and full application of the Qualifications Directive, which recognises persecution for sexual orientation as a ground for granting asylum and requires Member States to consider the individual case and the situation in the country of origin, including laws and regulations and the manner in which they are applied;
3. Believes that the EU and its Member States cannot apply European and national laws and procedures in a way which results in the expulsion of persons to a third country where they would risk persecution, torture and death, as this would amount to a violation of European and international human rights obligations;
4. Appeals to the Member states involved to find a common solution to ensure that Mehdi Kazemi is granted asylum or protection on EU soil and not sent back to Iran, where he would be executed, thus ensuring that Article 3 of the ECHR is fully respected by all European authorities and notably, in this case, by the UK; asks the Commission and the Council to fully cooperate with the Member States on this case;
5. Asks EU institutions and Member States to take action to prevent similar situations, in the future, through cooperation and EU guidelines to find solutions in similar cases; asks the Commission to monitor and evaluate the application of EU asylum law in Member States, and in particular as regards sexual orientation, and to report to the European Parliament; underlines the fact that the Commission has announced, for 2008, amendments to the Dublin Regulation and the Qualifications Directive which will address the issues raised in this resolution;
6. Instructs its President to forward this resolution to the Commission, the Council, the Member States, the United Nations High Commission for Refugees and Mehdi Kazemi.

FIONA HALL INTERVENES IN ASYLUM CASE

Fiona Hall has signed a letter to Prime Minister Gordon Brown, in support of Medhi Kazemi. Medhi is a 19 year old homosexual from Iran who fled the UK after the Government refused him asylum.
Fearing deportation back to Iran, where he would likely be detained, tortured or killed for his homosexuality, Mr Kazemi fled to the Netherlands, which is currently reviewing his application for asylum there.
Commenting on the case, which has attracted widespread support, Fiona Hall said:
“There are European and international human rights laws that should prevent the deportation of individuals back to countries where they are likely to suffer harm or be killed. There is great concern in this instance due to the initial refusal of the UK Government to grant Medhi asylum.
“I have co-signed a letter to the President of the European Parliament, the EU Commissioner for Justice, Franco Frattini, and a number of EU prime ministers, calling on a common European solution to allow Medhi Kazemi to remain within the EU under asylum or international protection status.
“It is not acceptable that this man be allowed to be deported. The EU is globally respected for upholding ideals of tolerance and freedom and I will do all I can to ensure that Mr Kazemi not be deported.”

"Ho accettato con piacere la richiesta dei colleghi Marco Cappatto e Marco Pannella di sottoscrivere l'appello al governo olandese affinché conceda l'asilo politico al giovane iraniano Seyed Mehdi Kazemi, che attualmente si trova presso il Centro di detenzione dell'aeroporto di Rotterdam e che attende di conoscere la sentenza della Suprema corte olandese.
Il rischio che Seyed Mehdi Kazemi venga condannato a morte per sodomia nel caso di un ritorno nel suo paese deve essere evitato a tutti costi. Rinnovo il mio appello alle autorità iraniane perché venga finalmente riformato l'ordinamento penale e che l'Iran aderisca alla moratoria dell'ONU sulla pena di morte. Si tratterebbe di segnali che l'Unione Europea valuterebbe senz'altro positivamente, anche alla luce del confronto tra Bruxelles e la repubblica islamica sul nucleare e sui diritti dell'uomo".
Spero che l'incontro che si è svolto ieri a Roma tra alcuni funzionari dell'Ambasciata olandese e una delegazione del Gruppo EveryOne e di Nessuno Tocchi Caino sia stato in tal senso utile e spero al più presto di poter incontrare l'ambasciatore iraniano a Bruxelles per potergli illustrare di persona le ragioni delle preoccupazioni europee".

Dear all,
most of you are aware of the case of Medhi, a gay Iranian citizen that risks to be repatriated from the NL to the UK (judgment by the NL court is expected on the 5th of March) , where he risks to be deported to Iran where he will for sure be killed - either by the State or by his father.
This could be a subject for a urgency resolution, which could be requested for ALDE and agreed at tomorrow's ALDE WG C.
In the meantime many of you have taken initiatives on different fronts. Sarah wrote to the UK Home Office, GW has a letter on its way to Brown, Sophie and her Dutch colleagues are active on their Dutch authorities, Marco Cappato and the Italian Radicals asked the IT Ministry of Foreign Affairs to raise the issue with the NL and UK authorities.
The Mehdi case raises a series of very serious issues:
- the way MSs apply apply the asylum regulations in relation with sexual orientation (in this case the UK and Greece in a similar case)
- the cooperation between MSs on the asylum regulations ( Dublin )
- the fact that these 2 elements combined lead to the concrete possibility that a person is sent back to a country where he risks death penalry, which is forbidden by the ECHR and EU law.
- the precedent of Pegah: the UK authorities renounced to deport her, but she is still waiting to know her fate....
The urgency resolution could address these issues and could help to save the life of a person, who is currently on hunger strike and risks to be sent back to a place where homosexuals are sentenced to death penalty.

Betreft: Deportatie van een homoseksuele jongere naar Iran
Seyed Mehdi Kazemi, een homoseksuele Iraanse jongeman van negentien dreigt door de Britse autoriteiten te worden teruggestuurd naar zijn land, waar hem een gewisse dood wacht. In oktober 2006 hebben de Britse autoriteiten zijn verzoek om politiek asiel afgewezen en hem gearresteerd met het oog op zijn deportatie naar Iran. Nadat hij was vrijgelaten is Mehdi naar Nederland getrokken om daar politiek asiel aan te vragen. Die aanvraag is - volgens informatie waarover wij beschikken - na een buitengewoon discriminatoire en foute procedure afgewezen. De Nederlandse autoriteiten maken zich op om Mehdi terug te sturen naar Groot-Brittannië, waar het gevaar dreigt dat hij wordt uitgewezen met bestemming Iran, dat hem dreigt ter dood te veroordelen.
Is de Commissie bereid dringend maatregelen te nemen opdat de lidstaten de Europese wetgeving (Richtlijn 2004/83/EG1) en het internationale recht (Verdrag van Genève) naleven en geen asielzoekers uitwijzen naar landen waar zij dreigen te worden vervolgd en ter dood te worden veroordeeld, in het bijzonder op grond van hun homoseksuele geaardheid?

Seyed Mehdi Kazemi, een homoseksuele Iraanse jongeman van negentien dreigt door de Britse autoriteiten te worden teruggestuurd naar zijn land, waar hem een gewisse dood wacht. Appeal to block the deportation of Medhi Kazemi, gay Iranian asylum seeker, from the EU to Iran

Dear Commissioner, Dear Prime Ministers, Dear President,
we would like to express our serious concern regarding the fate of Medhi Kazemi, a 19 years old gay Iranian citizen who has requested asylum in the United Kingdom and had his application turned down. Fearing deportation, he fled to the Netherlands, where he applied for asylum. Dutch authorities are right now examining his request and deciding on the basis of EU law on whether to send him back to the UK - leaving to UK authorities the final decision on his possible deportation to Iran while not using the possibility foreseen by art. 3 (Chapter II) of the Dublin Regulation.
As you will be aware, Iranian authorities routinely detain, torture and execute homosexuals. Medhi's partner has already been executed, while his father has threatened him with death. Article 3 of the European Convention on Human rights, as well as the Charter of Fundamental Rights and international human rights law, prohibit the removal, expulsion or extradition of persons to countries where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment, whereas EU law recognises sexual orientation as a ground for Member States to grant asylum. It is not understandable, nor acceptable, that the EU or its Member States apply European and national laws and procedures in a way resulting in the expulsion of persons to third countries that would persecute or kill tem, furthermore in violation of European and international human rights obligations.
We consequently appeal to you to find a common European solution to ensure that Medhi Kazemi is granted asylum or international protection on the EU soil and not sent back to Iran, where he would be executed, hereby ensuring that article 3 of the ECHR is fully respected by all European authorities and notably, in this case, by the UK.
We also ask you to take action to avoid that similar situations do not happen in the future.
